TERMS & CONDITIONS
These Terms and Conditions (“Terms”) are a legal agreement that governs Borden Games Co., Ltd (“Borden”) and the Users (“You”) of our website One Hit Jackpot (“Services”). By installing or using our Services, you agreed that you have read, understood, accepted with the Terms set forth.
Borden has the right to make changes to these Terms and you further agreed to be bound by any modifications done by Borden at any time at our sole discretion. Your continuous usage of our Services resembles your acceptance to our revised Terms.
The use of our Services is intended for those 21 years old above for entertainment purposes only. By using our Services, you confirmed that you are more than 18 years old. If your age falls between 13 to 18 years old, you hereby guarantee that your legal guardian has reviewed and agreed to these Terms. If the Users have a limited capacity (over 7 years old but less than 20 years old), they must obtain a permit from their legal representative (e.g. parents, guardians) before they can register to our Services. If the Users are incapacitated (less than 7 years old), registration should be made by their legal representatives on their behalf. Any agreement entered into our Service are deemed to have been obtain through legal representatives and complied with legal requirements.
A. ACCOUNT INFORMATION AND SECURITY
To start accessing and playing our Services, you need to create an account that may require you to provide complete and accurate information. The following rules shall govern the safety of your Account and Login Information (“Account”), including but not limited to usernames, passwords, and security questions, in using our Services:
Your Account are confidential and you shall not share such information under any circumstances that might jeopardize the security of your Account.
You are responsible on all activities done under your Account, whether or not such actions were taken by you.
Your account may be terminated at any time, for any reason, including but not limited to claims by a third party that your Account violates third party’s rights.
You understand that your Username and profile picture will be publicly available and that search engines may index it.
Personal information that you provide upon registration, including your name, email address, birthdate, and payment information will be held and used in accordance with Borden’s Privacy Policy.
B. USE OF SERVICE
Subject to your agreement and compliance with Borden’s Terms, you are hereby granted a non-exclusive, non-transferable, revocable and limited rights to access our Services. The use of our Services shall be solely for your personal and non-commercial entertainment purposes only. You hereby recognize that your license to use our Services is bound by these Terms and in case of any violations, your license to use our Services shall be immediately terminated. You further agree that your use of our Services is in accordance with the law of your country to which you are situated.
C. INTELLECTUAL PROPERTY RIGHTS
Borden has all the rights in all the materials and contents (“Materials”) used in the Services, including but not limited to the software, communications, websites, designs, graphics, texts, sounds, music, videos, and information. Such Materials are protected by applicable trademark laws, copyrights, patents, trade secrets, international content, and other intellectual property rights and related proprietary rights. You are not authorized to reproduce, transmit, convert, edit the Materials or any related acts without Borden’s authorized and written approval. You hereby confirm that you do not obtain ownership rights by using our Services including its Materials. Violation or infringement of the property rights of such Materials shall bear all legal responsibilities.
D. ACCOUNT TERMINATION
Borden reserves the right to terminate, suspend, and cancel your Account, if applicable, at any time, for any reason, or any suspected violation of these Terms. Upon termination, you will not be able to access your Account, use our Services, or obtain the benefits associated with your Account. You further acknowledged that Borden can terminate your Account without prior notice and Borden will not be liable to you or to a third party as a result of the termination of your Account.
E. VIRTUAL IN-GAME CURRENCY
The Services may provide an opportunity for you to exchange real world currency to in-game Virtual Coins. You are responsible for all the fees and charges related to your purchase of Virtual Coins, including applicable taxes. Borden will not be responsible for any issues that may arise related to the services offered by the payment provider in connection to your purchases. Prices and availability of the Virtual Coins are subject to changes without prior notice.
Upon completion of purchase, such transaction is not refundable, transferable, or exchangeable unless in Borden’s sole discretion. You are not allowed to sell or purchase these Virtual Coins outside of our Services that constitutes a violation of the Terms and will result to Account termination or will be subjected to legal actions.
F. REFUND POLICY
“Refund” refers to the reimbursement for the loss in virtual currency in the game. Borden will refund the players for any losses if the following conditions are met:
Losses are due to either of the following:
Server instability and crash, system malfunction, shutdown due to maintenance
Bugs, glitch, code, or logic error, erroneous policy, and operational errors
Abnormalities with activity logs and system
The issue is raised within 30 days from the date when the loss occurred
Borden has no responsibility for any loss or damages arising from players’ unstable connection, duplicate logins, outdated mobile / PC versions, virus, malware, hacking, or possible issues caused by third party’s sites.
G. GAME RECORDS
Borden will retain the game history of the Users for 30 days for future queries.
Users can access their gaming history through written or online inquiry, or through the Customer Service Call Center and must submit their personal information that is consistent with their game profile.
H. COMMUNICATION CHANNELS / SOCIAL MEDIA PLATFORMS
Community Forums, chat areas, and the like are provided by our Service to enable communication between players. Borden has no obligation to monitor these channels but has the right to review the materials posted. Borden reserves the right to terminate or suspend your account in accessing these channels at any time, for any reason.
You further agree that all your communications in these channels are public and expect no privacy regarding your usage. You are solely responsible for all the information that you choose to share or for the actions of other users.
I. THIRD PARTY SITES
While playing or using our Services, there might be third party services or advertisers who have promotional offers and rewards that will direct the Users to Third party sites that will collect some information. Borden is not directly or indirectly affiliated with the linked sites and will not hold any responsibility or liability from actions done from these sites. You also acknowledged that Borden has no control over the information and activities included in these sites and accessing such is at your own risk.
J. LIMITATION OF LIABILITY
You expressly acknowledge that your use of our Services shall be at your own sole risk. Borden makes no warranties or representations about the accuracy and completeness of the content of our Services and shall deemed no responsibility or liability for any:
Personal damage and injury resulting from the use of our Services
Any interruption or connection loss to or from our Services
Any bugs, viruses, and the like which may be transferred to or through our Services by any third party
Any errors and inconsistencies of the content of our Services
Any user content you post or share on or through our Services
Any claims made by third party against you by using our Services
K. ENTIRE AGREEMENT
These Terms, along with the Privacy Policy, regarding our Services constitute the entire agreement between You and Borden Technology Co., Ltd. This agreement supersedes and replaces any prior agreements relating to the subject matter hereof.
L. GOVERNING LAW AND JURISDICTION
You are responsible for all governing laws applicable to your country of residence and Borden will not be held liable to any claims regarding your use of our Services.
These Terms, its related administrative interpretation, applicable laws, and rights and obligations of the parties involved are governed by the abiding laws of the Republic of China. You further agree that any claims and disputes arising from this Terms will be settled by the Jurisdiction of the Kaohsiung District Court.
